A few of you who follow me on twitter know I’ve been dealing with a nightmare with PayPal the last few weeks. After dealing with my own agony and reading scores upon scores of other heartbreaking and horrible stories written by other paypal customers/victims I finally decided to write about it here and warn my followers about the current dangers of using paypal.
Lots of people use paypal. It’s easy to use, free to set up, and feels great when you see that money pop into your account. It’s great for small businesses, great for photographers, and even great for family members. It’s been great for me, a loyal customer for over 6 years.
It’s great that is until you wake up one morning to withdraw your money from your account and see a ‘pending balance’ that looks like this:

And then when you click on the ‘view your reserve’, it takes you to this:

And then when you keep clicking further it takes you to this page, telling you when you’ll have access to your funds:

You see the explanation there in the image above under ‘account reserves’, that the reserves are to cover chargebacks and reversals. Ok, fine and dandy, except the payments I received through paypal above were for services. Services I have already rendered. There will be no products returned or exchanged, no customers waiting 90 days to contact their CC companies and say “I never received that service”, no shipping issues or delays, for these services, already rendered, that I received payment for. That PayPal is now holding.
Paypal, in the past year, has started placing 20-50% holds, for 90-180 days, on most of their customers’ money. If this hasn’t happened to you yet, just wait a few days/weeks- it WILL.
This brings me to my next point, which is really the most important one. This is a comment I left on the CNN Money blog.
I regards to their holds and rolling reserves, Paypal spokeswoman Amanda Pires says: “Obviously, it’s legal. We wouldn’t do it if it wasn’t” , noting that the right to temporarily hold funds is reserved in PayPal’s user agreement.”
WRONG.
It’s not legal. It’s ILLEGAL. And just because a major corporation has a term in their user agreement that users agree to does NOT make it legal. Nor would that term ever be binding in court. I think I’ll put a term in my T&C that says “I have the right to kick your dog in the head during our photo shoot”. My client might agree to it, but does that make it legal? Absolutely not.
I’ll make this very simple.
Paypal is not a bank or a merchant account or what one person referred to as a “deposit broker”. They do NOT have the rights of these types of businesses.
PayPal’s business type is: “Money Transmitter”.
This is by their own admission via their money transmitters licenses (many expired) in each state. See the links on their about page:

A quick scan down the page shows that their licenses are Money Transmitter licenses.
BY LAW, PayPal is required to operate according to Money Transmitter laws in each state.
In Washington State, RCW 19.230.330 reads:
“(1) Every money transmitter licensee and its authorized delegates shall transmit the monetary equivalent of all money or equivalent value received from a customer for transmission, net of any fees, or issue instructions committing the money or its monetary equivalent, to the person designated by the customer within ten business days after receiving the money or equivalent value, unless otherwise ordered by the customer or unless the licensee or its authorized delegate has reason to believe that a crime has occurred, is occurring, or may occur as a result of transmitting the money.”
(I imagine the laws in each state are similar.)
Without just cause of witholding money (i.e. a VERIFIABLE crime has occurred), paypal’s practices are ILLEGAL, pure and simple. Their sidestepping demands to show proof a crime has occurred, their lack of any formal documentation justifying witholding their customer’s funds and their practices of updating their policies without notifying members are all- ILLEGAL.
I have absolutely no problems paying my $29 fee and making a couple of appearances to take them to small claims court to get my $1500 they are illegally holding without just cause. I will also be charging them for lost revenue, calculated by each hour I have wasted battling this issue with them. And once I get my money, they will never make a dime in interest (or fees) off me ever again. I am delighted at this point to take my annual revenue elsewhere. I’d pay $1,000 for a CC processing machine to never have to utter their business name again.
I wish everyone else felt the same way too. If more people stood up for themselves and actually took legal action, we might be able to stop a wicked corrupt conglomerate like PP from ruining countless others businesses and lives. It HAS to stop.”
Regardless of their user agreement, or their ‘logic’ and ‘reasoning’ behind their policies, they are breaking state laws, pure and simple.
Now here is something you didn’t know about PayPal (and something I certainly never knew until recently).
They were sued in 2002 for this very issue, and settled out of court to the tune of $9 million, which is a drop in the bucket to a company that pulls in BILLIONS in annual revenue. (More on lawsuits later on).
Now, back to the reserves. This seems to be happening to so many PP customers (keep reading to the end for proof), that I did a little math to figure out what kind of interest they must be generating from holding my, and thousands of others’, money.
They say on their site they have 220,355,645 accounts worldwide (that number ticks up every second or two).
That’s 220 million+ users.
Let’s say they are deciding to arbitrarily (check out the links at the end for proof of this arbitrariness), withhold 30% of only 10% their customers’ funds for 90 days (many are being hit by 180 day holds and reserves- as much as 50% of their revenue).
10% of 220 million customers is 22 million. (I’m being generous with them here as I suspect the percentage is closer to 50% or even higher).
Now, there are PP customers who bring in $50 per month, and those who bring in $50,000 per month. Let’s say the average amount of money held by PP is only $2500 (again, I’m being very generous, which you will see when you do your own research).
$2500 x 22 million users = $55,000,000,000.
Hmm, what’s that number?
$55 BILLION. $55 Billion dollars they are holding. For their own use. For any amount of time they decide.
How much interest do you think this company could make off of $55 billion dollars? How much for 3 months? How much for 6 months? How much for a year or more?
Now since I’m being very generous (there are currently PP customers who have $30,000 or MORE locked in their PP accounts), let’s double this and make it an even $100 billion dollars they are just ‘holding onto’ for whatever length of time they decide.
Now you start to see the issue.
They are not, as they say, protecting their buyers and sellers from fraud, they are not covering chargbacks (refunds and chargebacks do NOT get processed from the RESERVED funds- they get processed from AVAILABLE funds), they are not in any way working in the interests of their customers on either side, and in many cases, they are NEVER. EVEN. RELEASING. THE. FUNDS.
Scared yet? Angry yet? You should be.
Now, many of you may be thinking “But Jamie, where did you get this information?”. “Where’s the proof?”. The proof lies in the vast amount of information out there in the great world wide web.
Here are just a few links I can give you to do your own research on PayPal’s customers’ collective experiences. Please note that some of the articles are old (because this issue has been going on unchecked for years), but many of the comments are not. Read through the comments and look for those left in 2009 and 2010.

Ok, so, as if that’s not enough, it gets worse. (“Worse Jamie?”). Yes, worse.
A couple of months ago, before I learned all of this, my colleague Nichole and I were needing a payment option for our workshops registration payments for our Passport NYC workshop. “Paypal- perfect!”, we thought.
So we collected the registration payments, and about 3/4 of the way through, all of this sh*t hit the fan.
“Oh my god they could lock our account arbitrarily or place a 30-50% hold on our funds for 90 days- which is PAST the workshop date. We’d be screwed!!”.
“Ok, no problem” we thought. We’ll just transfer our funds into a bank account to get them out of there.
Only, there was a teensy little problem with doing that.
Upon attempting to withdraw our funds from our account, we received an on-screen message saying “you have a $500 monthly withdrawal limit”.
$500 MONTHLY. MONTHLY.
“Ok, don’t panic, we’ll call them to find out what we need to do to get our money out”.
Here is what we were told:
“You need to verify your account. In order to verify your account you need to: 1) associate a bank account number that is not already associated with another PayPal account, 2) associate a credit card number that is not already associated with another PayPal account, and 3) associate a social security number that isn’t already associated with another PayPal account.”
“Great, awesome!”
Except no, not awesome. Not awesome at all.
Nichole and I each already have a Paypal account, with all 3 of those items associated with each of them.
Before any of you get all snotty and say “well you should have known that before you set up the account for the workshops payments.”
Let me be clear on this: Nichole called them BEFORE she set the account up, and explained that we were partnering on a business venture, and needed a shared account that we could both access. They explained to her how to set it up, indicated we could have one debit card in one person’s name (but not both), and AT NO TIME during that conversation explained that it would be nearly impossible for us to withdraw/transfer our own money out of our new account.
Knowing what I know now, of course they didn’t. Every new account is like gold to them. They want to get you in. They don’t care about you once you are in. They just want your money.
The good news is that Nichole was able to make some changes to her existing PayPal account (I’m not sure what exactly) and get our money transfered out of PayPal before being hit with their holds and reserves. We check in several times a week now to make sure the account has a zero balance. (WHEW.)
So that problem is solved, but I have another problem coming up next week that pains me to no end. I have been having stomach cramps for days just thinking about this.
Starting on Monday, June 21st (a few days from now), I will be registering folks for my September workshop, and taking payments through my PayPal account, the one that currently has a 30% 90-day hold on it. Given what I’ve read in forums, one of the ‘triggers’ for having your account be completely locked-down is having a large amount of money come in at one time. When that happens, they can block access to your money for months and even years, requiring ‘paperwork’ to prove you aren’t a criminal. In most cases I have read that once paperwork is received, they do nothing. They decide arbitrarily when and IF they want to release funds. PayPal customers are completely powerless, which is the whole thread through everything I’ve read.
So right now I run the risk of collecting many thousands of dollars I might never see again. I can’t in fairness ask my attendees to pay me in cash, so that’s a risk I have to run. It’s too late to apply for a merchant account with another vendor as it would take too long and I need a system in place right now.
The good news is I have cash set aside in my bank to cover all of the expenses of the September workshop, should the worst-case scenario happen.
Next week I will be in my PP account every hour, transferring any available funds like a crazy person. Although I have read that there have been those who have enacted transfers to their bank accounts that have been reversed by PayPal, so that’s not even a guarantee I’ll get the money. Understand my stomach cramps now?
It’s BEYOND crazy-making to be having to deal with this, but I am thankful I am not one of the many who have had their livelihoods completely ruined by paypal, and forced to declare bankruptcy. I’m trying to see the silver lining and be positive.
But that’s not all I’ve done. Oh no, of course not (some of you know me well enough to know I won’t stand for this).
I have taken the advice of others online, and done this:
1. Submitted a formal complaint with my Secretary of State, the Washington State Department of Financial Services, to be exact. For those in Washington State, you will need PayPal’s contact info and license #, and you can find both in their licensee database here after checking the ‘money transmitter’ box on the search page and entering ‘paypal’ into the business name box.
2. Contacted the attorney’s Freed & Weiss in Chicago about adding my name to the class action lawsuit against PayPal they filed last month.
Which brings me to my last point.
Last month, on May 12th to be exact, a new Class Action Lawsuit was filed by a Chicago Law Firm, Freed and Weiss, against PayPal and Ebay, over the very issue I have detailed in this blog post- reserves and holds.
Freed & Weiss has a page on their site where you can read about the suit and contact them to get more information.
They also have a link to the entire suit as a pdf, which was filed in San Jose California, where PayPal are based.
(warning- it’s a very long legal document and not an easy read!)
Let me be clear- this is a current, and very recent, class action lawsuit, that has just started. If you’d like to read about other lawsuits brought against PayPal, see the Litigation section of their Wikipedia page.
If you are one of the many who have been a victim of paypal’s policies I urge you to contact Freed & Weiss and add your name to the suit.
If this happens to you in the future, the best things you can do are:
1. Save all communications with PayPal as PDF files.
2. Save all information in your account, including current and reserved balances, as either pdf files or screen grabs (I’ve noticed they have changed my account info several times since enacting this on me but thankfully had already saved the pages as pdfs).
3. File a formal complaint with the Secretary of State in your state, specifically to any division that deals with consumer complaints about financial companies (they take this very seriously).
4. Email Freed & Weiss about information on the lawsuit.
How can you PREVENT this from happening to you?
Easy (ok, well, sort of):
1. Set up a new merchant account. With anyone other than PayPal (I may end up using Costco’s merchant processor who I’ve heard great things about.) Yes the process will be more complicated, but the per transaction fees will be much lower, saving you time and money in the long run.
2. Withdraw any funds you have in paypal immediately. Make sure you have a zero balance.
3. Immediately disassociate any credit cards and bank accounts you have connected to your account (they don’t make this easy and will give you ‘can’t remove due to pending transactions’ BS). They can, and will, tap your bank account and credit cards for superfluous reasons *after* you have closed your account.
4. Close your PayPal account.
When they ask you why you want to close your account, simply state:
“Because your holds and reserves are illegal in my state according the laws that govern Money Transmitters. I do not wish to do business with, nor support, an unethical company who breaks laws and puts their customers’ livelihoods at risk in the process.”
Now, with that said, I need to go take some Tums. My stomach is killing me.

6/23/10: Updated to add:
They are now holding $3800 of my funds, and I have a negative $1750 balance, because although the money was shown as available when I transferred it to my bank account, they are now placing a hold on $1750 retroactively. If you are in a position of having your money held, watch out for this! I’ll be anxious to see if they start taking money from my bank account, since they have that account number and according to their ‘policies’, they can do whatever the hell they want.
Also, I heard back from the attorneys at Freed & Weiss yesterday and will be sending all of my info to them shortly. A big thanks to one of the head litigants, Brian Pattee, for commenting on this post!
Lastly, I’ve had people ask why I didn’t try and resolve this with them by phone, to which I say, “duh”, of course I tried the phone route, which is why I waited 3 weeks to post anything about this.
Here is how the first conversation went down:
Me: “I’m curious to know what makes PayPal determine what percentage to hold and for how long, and if that ever changes.”
Him: “I can’t really tell you why, or when it will change, but I can tell you it’s to cover chargebacks and reversals”.
Those are the answers you get when you call CS. In other words, a non-answer. They are essentially reading from a script. PayPal CS is always very friendly (that’s never been an issue), but they don’t understand what’s going on with their company. Or they do, but given the weak economy, choose not to say anything for fear of losing their jobs.
And when I called last week to ask why, when I try to remove a credit card # from my account, it keeps saying “You may not remove your funding source while an authorization is still pending.”, they said “you have a pending transaction with Vonage”.
I changed my payment method with Vonage, and they were never on my pay list to begin with, in other words, that credit card was never a primary funding source, not even when I set up the Vonage account, so I still don’t have a reason why I can’t remove it. Wait, yes I do, so they can access my CC in the future if and when they want to. I’ll keep y’all updated as to if I am ever able to successfully remove it from my account.

I am very happy to report that I got my money back:
Immediately after receiving the complaint I filed with the Washington State Department of Financial Services, Paypal lifted the holds on my funds, reversed all reserves, and removed all indications from my account that any reserves had ever even been placed. Also, now when I transfer money from my paypal account into my bank account it takes only 2-3 days, whereas before it would take 7-10 days. I know this because I used to track on my calendar how long it would take.

Oh, and to those commenters who claim paypal is breaking no laws, please explain to me why they would have lifted the hold on my funds after being contacted by the Washington State Department of Financial Institutions. Why would that have changed anything if what they were doing is perfectly legal?? I would love to hear your answer on that. Thank you.

Great write up here. Thanks for helping the general public be aware of PayPal’s true business schemes. As one of the head litigants in the Class Action Suit filed in May, it’s gonna be a treat to watch PayPal and eBay both squirm in their seats at a jury trial =) Keep up the good work.
You are screwed now.
I went through the same thing with paypal. They held a reserve and then contacted my customers with a message that basically said “Just ask for your money back, we will give it to you”. When I complained they closed my account and told me they would give me my balance in 90 days. I received about 10% of what was there.
I will be closing my account as soon as I can work out another arrangement to receive payment for a shoot in July. YIKES! Good Luck to all of us!
Oh my good god! I only use Paypal sproadically…mostly for eBay related purchases…..but I had been toying with the idea of opening a merchant’s account with them. Not any more!
Jamie, my wife was an eBay powerseller for years and I can’t tell you how many times PayPal has held money or done chargebacks. With the numerous changes on eBay and PayPal, we’ve been winding the business down and will be closing it at the end of the year. I applaud your stand against this financial tyranny. Good luck!

I’ve been pretty mad at Paypal/Ebay for awhile now. I’m tired of the double-dipping they do with fees. If you owe them money, they’re very quick to take it, but they owed me $53 for months and I had to contact them SO many times to receive my credit. Thankfully I did finally receive it. It seems like a trivial amount next to your mess, but you’ve certainly inspired me to shut that account down. And Ebay. It’s all just so terrible. I’m going to pass this link around!
I’ve switched to Google Checkout for my small businesses. I heard way too many stories about chargebacks from clients (in this case, renters of vacation rental properties) who had no basis (i.e. after using the property for their trip), but knew that Paypal was buyer-friendly and the owners of the properties had little to know recourse. Google Checkout is a bit more of a pain for my clients because you have to have or create an account, but I’ve had no complaints to date.

Wow, Crazy!!! I can’t believe this has been going on for so long! Thank you for posting this info which obviously has taken some time to collect. You’re awesome! I was considering opening my account up to accept payments, but I will NOT be doing that now!!!
There I thought PP would be great for every one to transact Internationally w/o having to pay high bank fees in translation and overseas transaction. I wonder what are their business practices – sloppy?
Thank you for posting this. I own a small seasonal business and my customers have been asking us to set up a paypal account so that they don’t have to write a check, even though we send them a pre-stamped envelope. And like you, we are a service oriented business and are paid for services already performed. If we had our funds held that long during any part of our season, we would be be bankrupt!
Have none of you tried Google Checkout? It is my preferred provider. Much safer for sellers than PayPal and because buyers use a credit card it is safer for them too.

This happened to my mom YEARS ago. Back in the early days of the internet. I’ve never opened a PayPal account because of what happened to my mom – they stole hundreds and hundreds of dollars from her. They’ve been doing this for years, it’s ridiculous that they’re still in business!!
@Brian- I just heard from the Attorneys and will be sending them my info shortly. I’ll be watching this trial with baited breath, and will BEG of you not to settle! It sounds like a trial is the goal, and I am so happy to hear that. Major kudos to you for getting this going!! They need to be stopped!! @Vince- your story echoes what I have read from so many people on forums. I can only hope that this lawsuit finally sees some justice done for the victims of PayPal. @stevea- not surprised at all to hear that, and I hope you guys are able to close your account with minimal issues. From what I read they don’t make it easy. @Erika- it’s completely riduculous that they also target ‘the little guy’ and keep small amounts of their customer’s money as well. This company generates BILLIONS! @Allie- I may check out google checkout too, although at this point I feel safer going with a merchant account. Hell, what am I saying, I don’t feel my money is safe anywhere I currently have it (I also bank with Chase, which is a whole other story/nightmare). @Julianna- I have read equal complaints from international users, if not more even because just because you aren’t an American citizen you are suspected of nefarious wrongdoings straight out of the gate. @happyvalleygirl- many many people who have had this happen to them HAVE gone bankrupt! It’s so incredibly sad that this is happening time and time again. It HAS to stop! @Anita- Oh my god! This happened to MY mom too, recently! And I thought it was an isolated incident. Stealing money from elderly people on a fixed income? What kind of horrible, corrupt, morally bankrupt company would do such a thing? Oh that’s right- PAYPAL!!!

I just found this post while looking for a class action suit to join. Paypal is currently in the process of trying to steal $900 from my friend and I. It’s a big chargeback mess that started with paypal holding funds. They have released the funds, but only because of the chargebacks and now they say I owe them money. I refuse to pay ANY money back to a criminal. This guy in china whom we sold some action figures to also EXTORTED money from another ebayer in february. Last I checked… that’s illegal. But of COURSE paypal will side with this criminal- THEY AE CRIMINALS THEMSELVES. When and if this EVER gets resolved… I’M CLOSING MY PAYPAL ACCOUNT. And while I’m at it, I’m joining that lawsuit. >:(
It’s sad that paypal does this to so many people! But… at least we have each other, right? For all the good that does, money-wise. I just wish I’d been aware of their terrible practices before this happened… I would have cancelled my account long ago. I CHANGED my bank account # because of this, and closed the account that PP has, so if they try to steal my money they will get a nice surprise. I can’t do that with my credit card that I attached to it, though :/
Although, I’ll have to look into what you mention about them not being LEGALLY allowed to remove any $ from your account.

Paypal is nothing but as massive criminal scam hiding behind a veil of legality. Here’s the Paypal modus operandi:
1. You open a Paypal account and use it to accept payments on eBay or your website.
2. Everything goes fine for a while.
3. Paypal suddenly freezes your account and demands a ridiculous laundry list of papers and documents that they know you don’t have.
4. Paypal then keeps your money when those documents are not provided, and sometimes even if they are.
Paypal has done this to thousands upon thousands of people already and has stolen millions of dollars using this tactic. Paypal is a criminal organization and everyone involved in the company should be serving hard time in prison.
While, yes, sellers do have a right to be upset (I have been both a seller and buyer over the years, each very low in number) ANYWAY, one has to also consider such things as honest people making purchases who literally themselves, are victims of identity theft and fraud by nasty hackers out like — now that I think of it, I would not be at all surprised if those people WERE associated with PayPal! As I think back and now look at the papers that I had to fill out [though knowing my rights did NOT fill in] the ‘affidavit of fraud and forgery’ forms LITERALLY ASKS YOU FOR YOU ENTIRE SOCIAL SECURITY NUMBER! Why would they need that???
By the way, I never originally opened a merchant account, PayPal did that for me, GEE THANKS.
They also billed me with an incorrect name, under an incorrect birth date, and by NCO COLLECTION AGENCY GOT TWELVE OR MORE ACCOUNTS PLACED ONTO MY CREDIT REPORT. Now do not get me wrong, this is a great write up here, likely true no doubt, but do not forget that while yes, PayPal is a ‘money transmitter,’ they ‘transmit’ via one bank [yours] through them selves [that is said PAYPAL] onto another bank [in my case GE Money Bank. What I mean to say is, there is a THRIFT behind this TRANSMITTER. SO CONTACT YOUR STATE OPP [VIA Your own state's Federal Trade and Agriculture Consumer Services] who will then/ should or if not do so yourself; contact the OFFICE OF THRIFT SUPERVISION. Not about PayPal. THE BANK BEHIND PAYPAL.
I call various numbers on a daily basis to bug the people working there, waste their time and likely my own, and well; I do not know, after three years I have learned MUCH.
Now as for your accounts, the ONLY way to get rid of them is to contact NCO Collections agency at:
* Avoid the Phone – NEVER talk to a debt collector on the phone. Nothing good can come of it. The less they know about you the better. Politely tell them it’s your policy to deal with everything in writing and then hang up. If they keep calling, send them a cease & desist letter.
* Learn your rights – Debt collectors must play fair. Check out Fair Debt Collection – Facts for Consumers from the Federal Trade Commission.
* Record their calls – If you must talk with them, record them. Thirty-five states and the District of Columbia allow you to secretly tape your phone conversations. In the other 15 states, you can tape with the other party’s permission. If you tell the debt collector you are going to record and they keep talking, that’s considered giving permission. Usually they hang up.
* Debt Validation – Under the FDCA, you have the right to “debt validation”. Debt validation demands that the creditor reporting the information prove to you that the account is really your responsibility and that the balances, etc are accurate. Learn more about Debt Validation.
* Find out your state’s collection laws.

We started accepting paypal as an additional form of payment in March of this year,In April we received a notice that we needed to prove our identity and supplied over 43 documents pertaining to our business etc. We complied, In May we were informed that we would need a reserve and a rolling reserve of 10% daily for 180 days. We complied, in August we received an email stating that our complaint rate was above the 3% requirement, coming in between 2-4% monthly, we informed paypal of our problem with children making purchases online without parents permissions etc. We even have the documentation to prove this, we stressed that we honor our returns policy that if a customer wishes to return an order for any reason that they may, we also pointed out that our account had over 10,000.00 in reserves and an additional 4,000.00 in available funds, our average transaction or dispute on a transaction is 40.00 or less. We utilize click-n-ship on every transaction even when it costs us more so that we can have instant tracking and credibility with paypal regarding our orders. On Sept. 7th they froze our account holding over $14,000 in funds and stated that we could no longer be a customer. The funds will be held for 180days. In addition, they no longer will answer any questions we ask, they will not return emails or phone calls, and they are granting refunds to any complaint that is filed immediately without asking us for any documentation. We complied with everything paypal ever asked of us and I was actually a supporter of the system until now and in light of other complaints I was unaware of. I would like to join this class-action suit. I would like to ensure that our funds are going to be released in the 180 days as promised. In addition, thank God we have other merchant accounts or we would have been in dire straights.
It’s sad that you spent so much time putting this together but unfortunately all your facts are incorrect.PayPal is technically a processor and they abide by the laws set by V/MC. In regards to the funds you receive via any V/MC payments they technically are supplying a line of credit. In other words you’re in a lending based relationship. All processors also known as Merchant Acquirers will place reserves if they feel there is some type of risk. Here are some examples or risk; a financially unstable company (in other words learn a bit of finance and learn how to evaluate your current financial condition, especially liquidity ratios), a merchant with poor processing attributes, a merchant with poor or very little business credit, a new merchant with minimal history, etc, etc….
I have also been a victim of PayPal. I sold a computer for a friend for $1025.00. Someone used a stolen eBay account to place the winning bid. They subsequently used a stolen PayPal account to pay. Four days after receiving cleared payment, I shipped the item to the address given to me by the Ebay user. They claimed it was a gift for a friend so that didn’t seem too strange to me.
The next day I received an email from PayPal saying the transaction was unauthorized. They froze the money in my account pending an investigation. Today, they took it out of my account. So I shipped a computer to an eBay user who paid…the funds cleared…I shipped FOUR days after the end of the auction only to find out that it was a fraudulent buyer. Why should I have to pay for PayPal’s lack of security? How am I to know if an account has been hacked?
I have filed complaints with the Indiana Attorney General (they have responded already that they are investigating this case), FBI, BBB, FTC and U. S. Post Office Inspector General as well as my local police department.
I plan to contact our local media, and I have let “Meg” at PayPal know all of this as well. PayPal is a crooked organization. I told her that I may be one person, but I’m a very loud one.
I noticed that PayPal isn’t licensed to transmit funds in Indiana….does this affect my case in any way?

I don’t use PayPal to receive money. I use Google Checkout. Try it, you’ll like it.
When I do services, I send the client an invoice via Google Checkout. They use that to go to Google Checkout and make the payment, just like with PayPal.
I get the payment from Google Checkout in my bank account in about two days.
Google Checkout also is ever so slightly cheaper than PayPal, but not enough to get excited about.
And, you don’t even have to use a Gmail account with it. You can use ANY e-mail address with it to set up an account.
And I note, there is tons of phishing aimed at PayPal, and other security attacks. Since I use Google Checkout, I can ignore all that, don’t have to worry and check out my account to make sure. I’ve come across no phishing with Google Checkout. So, for that reason, I consider Google checkout to be more secure.
‘I know the truth’- no, I’m sorry, but YOU are wrong. Paypal is NOT a merchant processor, as you claim (I already explained that in this post, which I think you didn’t actually read), They are a Money Transmitter. (Did you not see all of the Money Transmitter licenses on their website?) I also already explained that as a Money Transmitter they are beholden to very specific laws in each state- laws they are blatantly breaking. IF they were a merchant processor as you claim, this whole thing wouldn’t be an issue, but they don’t get to follow the laws that govern V/MC merchant processors because, again, they are not a merchant processor, they are a Money Transmitter. The term ‘money transmitter’ is not a general term but refers to a specific type of business. Paypal is like Western Union. Same business type, different way of doing business. If you had read the post above this would have been clear to you. If you are still firm on your position of me being wrong, I challenge you to explain why they lifted the holds on my funds after after receiving my complaint from the Washington State Department of Financial Services. If what they were doing was perfectly legal as you claim, why would that have made any difference?? Please explain. Thank you!

Great Story! I immediately pulled up there license information for Florida. Get this…It’s expired and has been since April of this year. I’m sure it’s because they havent updated it. but still.

I feel very sorrow when i hear these type of mistakes done by paypal. I think people should stop to use paypal, thats the only way to stop it.
I am Paypal user for 8 years and haven’t any issues with them, till i opened merchant account. Then we did receive unusually big order for 800 $. I did transfer payment onto my checking account, but when i were going to actually ship the order,we found out, that it was placed from Malaysia and of course shipping and billing did not match. We canceled order and contacted Paypal. Their suggestion was to hold the money till chargeback filed and then just refund payment.After 3 month there was a chargeback against that transaction. So,right away i did transfer money from my account to Paypal, but because it takes 3 days i have had negative balance for 3 days. I received email from Paypal, that there will be 5 % rolling reserve for 90 days. I weren’t happy about whole situation, but i didn’t want to fight with reps, as i knew it wouldn’t be resolved. Then 2 weeks later, i received another letter from Paypal, disregarding first one and saying that there will be 15 % rolling reserve for 120 days. It hit our business really badly. We couldn’t pay for merchandise for our customers, we didn’t have enough money to ship orders. We used credit cards a lot( luckily we had funds available)!. Our credit scores got lower and we received few warnings due to unusual activity. At may 29th they didn’t released my money. May, 29th – contacted Paypal, they said account in good condition, but i have to contact Risk Department, as they are the “BAD”. And i got an impression from my conversation with rep, that my money might be on hold forever or at least till i will have merchant account. I immediately closed it at may 30st. June,4th – called Jamie Hodges, Merchant Risk Analyst – no answer. June 5th – call Jamie Hodges – no answer. June 6th – called Jamie Hodges -no answer. 10 days in a row _ NO ANSWER!!! and that is company asking Ebays buyers to rate seller for communication. Just imagine, if i would treat my customers this way??? July 10th i contact Paypal merchant Pro customer support and they said, that by closing merchant account i didn’t remove reserve and it will remain at least another 4 month. Ok, evils, i will wait. Contacted Paypal again at October 5th, they suggested me to contact Risk department again. This time i should contact Peggy Bang.The, the next day i received email From Peggy Bang, that she received my request to review my account and it will take 7 – 10 business days. When after 15 days i called the number given, there weren’t any Peggy Bang, but Vanessa Rodriguez and NO ANSWER.I called many times, then at December 23, emailed one more time and IGNORED at all. I still have Ebay account, associated with this account, but i am under seller protection. Now – after all of this – you want to hear Funny? At December 24th, i logged in into my paypal account to find out there is a dispute filed against transaction. I was surprised, as i do ship all item within couple of hours after order placed. I did check the transaction and time and order was placed 30 minutes before i logged in. It was tornado inside me. I got furious. I called Paypal and they said this is not me, but buyer. They didn’t have sufficient funds, when they placed an order, and Paypal asked me DO NOT SHIP item, till they will verify payment. I looked at the buyer’s history – and buyer have had 348 – 100% positive feedbacks. I thought u know what, let me ship item, even if i did not receive payment for it – it’s only 14 buks to lose, when i am fighting with paypal for $ 2800. I did ship item the same day and guess what? – next day hold for this transaction was removed, because TRACKING NUMBER WAS SUBMITTED. And Paypal didn’t allow me to use their shipping module, so i went to post office to ship that package. This whole situation leaves bad taste in my mouth.We are all under huge risk till Paypal Risk Management Department wouldn’t be closed. They are simply criminals. Today is January 22nd, – an year since they are holding my money. I have no hope to win with them directly, so i will contact law firm
I was just looking for a way to sell off my paypal stocks that i didnt even know i still owned from about 8 years ago when i came across this site. Again about 8 years ago I recevied a payment through paypal for about $1500, 3 months later i had a negative balance for the same amount. What happened is, I made some sales through ebay when i was preparing to deploy for the marines and i made the folish choice of letting one of my customers know i was leaving for the military for a while. He knew when i would be gone, so he disputed, and since i wasnt around to give my side of the story and say NO, he won by default and i was out 1,500. I hate paypal with a passion.
How do I file a claim?
I never did get the funds owed to me from my account.

I have the misfortune of having my account limited by PayPal. The placed a hold on my account and told me that they would release the limitation if I provided tracking numbers of 5 buyers that they chose at random. I not only provided the tracking number of the 5 buyers, I supplied the tracking numbers of all of the buyers. They then told me that they were not going to release my funds because they do not allow the sale of electronic cigarettes. I searched their website and no where on their website do they even mention the word “electronic cigarettes”. I called and the representatives were no help at all. They are a useless bunch.
I have filed complaints with the better business bureau, the FTC, with my Senator and Congresswoman, the banking commission and several other agencies. PayPal then had the nerve to email me asking why I was filing complaints.
I filed a case in small claims court and they are trying to get the case dismissed because they say that I can only file a case against them in Santa Clara, CA or Omaha, NE. I know of a case where they tried the same thing and they lost so I am hoping that that case will work in my favor.
We have been a paypal member for over 10 years. Since about 18 months ago, paypal has placed a 10% 180 day reserve on on account ( We sell about 100,000 per month through paypal ) This has caused over 30k of our hard earned money to be put on a long hold. We have been going emailing, calling, trying everything in out power to have this removed. Paypal is now simply ignoring us. They have told us that our chargeback rate is too high and thats what is causing this reserve. ( We have have 3 charge backs, totaling to less that $700.00 in the past 5 months )
Paypal is clearly taking merchants funds and using them to generate more capital.
We have already closed our ebay account and would like to get some legal help.
I would urge anyone to stay away from paypal.

As one of the head litigators in the latest class action suit against Paypal, I can say that I feel much better being a part of this suit and knowing that we are doing the right thing by taking on a monopoly – Ebay and Paypal!! I can’t wait to see where this lands, and I pray for Gods speed on this matter. It is a horrible feeling to wake up and go to look at your account and find your funds frozen. I spent the rest of that year and a good part of the next one stressed out to the max!!
Paypal took a double payment out of my checking account for a camera then claimed they didn’t do it. When I had my credit union reimburse one of the payments, they took the money away from the camera seller, made my account negative,and limited access to my account. It’s still not resolved and I’m thinking of sueing.
How does paypal get away with holding money they aren’t entitled to? It’s bad enough that by the time we pay ebay and paypal their “fees” we end up with nothing. They then hold our money that we are entitled to and expect us to ship our packages out using OUR OWN MONEY. They are holding my account now, and stole the money from my last sale, claiming they didn’t get their ebay fees from the last month when my bank records show a withdrawl. In addition, I have a negative balance that’ can’t be explained because they got the money. I should have a small balance. In the meantime, I have 3 packages to ship for THEIR BUYERS and can’t access my finds. I don’t sell on ebay to have my money on hold, and unacessible so that I have to use my OWN MONEY to ship these items with no sight of when I get my money. I had transferred my money to my bank account and they stopped the transfer and really expect that I will ship these items with no means to pay for the postage. Oh well. They are wrong. Their buyers will not get their packages if I can’t access my money. What’s worse is that one buyer has a claim open for non-receipt and they won’t even resolve this so they can get the shipment. If I don’t get paid, I don’t send out free merchandise. Sellers have no rights with ebay or paypal with all this “buyer protection.” A buyer can say anything and get their money back even if they receive the merchandise. No seller is going to risk NOT BEING PAID AND ALSO being subject to refunding money as a result of paypal’s f&cked up antics. Theya ren’t even polices..I got NO WARNING OR MESSAGE about any negative balance and I also got NO indication of any overdraw they are claiming occurred which didn’t because I have evidene that they were paid. They screw people over to sit on money for interest, and it is TOTAL CRAP. I would join and class action against paypal. I now will lose my ebay account over this and I simply don’t care anymore. When they do this to sellers, they lose money and also lose buyers.
Yup, we had the same thing happen to us. Paypal froze our account, locked our money up and told us they were limiting us from doing anything with it. Royally screwed us out of a month of bs’ing around. So we made a refund to the seller and found an alternative method of payment. Problem is, our account is still on lockdown and we can’t even close it. Damn crooks.
This is crazy. I had money held for no reason too. I think they should pay for doing people wrong.
I started using PayPal for my rental business, and had no problems. THEN one day out of nowhere I see “Pending funds”. I did not get an explanation from PayPal about this – I had to call them. When I did, I got all the same answers you all stated; need it for reverse backs, blah blah blah They have notes about my first call in December 2010. I called again today July 18, 2011, frustrated as we are headed in the heavy rental season and don’t want my funds held up again. I asked specifically WHY my account has a reserve, I was literally told there are a “million” reasons why it was placed on my account but he cannot tell me which applied to me. I explained I’ve never had an issue, never. I’m a good customer, pay my fees, that I feel I’m being punished in some way and would like an explanation for 20% of my money held for 90 days. Then I was told that my account was reviewed last December and removing the reserve had been “denied”. I asked WHY, still no explanation. I was also told that I cannot ask for my account to be reviewed more than once per year. At times, PayPal has held over 3,000.00 in my reserves. ALSO DISTURBING. There is a listing by month of the amounts held, but there is – at least not to my knowledge – a statement showing when the funds reappear. They leave it up to us to pay attention. Did it go back in? How much? WHat date? Unless you watch it DAILY how would you know? Why wouldn’t it be a part of all the other transactions on the statement so there is a paper trail to follow? BECAUSE they don’t want to show an accounting! I’m so glad to have found this site and other. DO NOT USE PAY PAL. It’s a fraudulent company. I will warn as many people as I can, and take part in whatever suits are out there to stop PayPal.

Hello. Are there any class action lawsuits being filed as of July 20, 2011. I became yet another PayPal victim recently. And the worst thing? The money was something I desperately need right now not half a year later. A measly ~$360, and they’d steal that away too.
I have violated nothing in their Acceptable Use Policy, yet when I try to ask them of my concerns, all they do is stonewall me with canned messages of ‘your account has been closed due to security reasons’. No other explanation.
It would have been fine if they’d return the money immediately to the bank account attached to the account. But no. They keep it in their greedy little hands in such a way that no bank would even dare.
I’m betting they’re earning billions from targetting small accounts like ours. Especially those which are not American.
So if you’re thinking of opening a PayPal account. FOR THE LOVE OF EVERYTHING GOOD, DON’T.
They’re the single most evil company I can think of at the moment.

I’m currently trying to gather enough people for either a new Class Action against Paypal or if nothing, the final nail in the coffin of universal awareness of how corrupt Paypal and Ebay have become.

All in all, I’m seeing two major illegal activities Paypal is involved in. The example here of holding funds which they do in various methods of which they not being a licensed or bonded bank, etc., gives them no right to do so in the first place. In fact, making interest off other people’s money in a manner that seems forced, contrived, strong-armed, etc., actually smells like mafia tactics of which I’m SHOCKED the US Government/Federal court system hasn’t intervened yet. Such mafia tactics usually get you in jail for LIFE.
The other problem with Paypal is that they aide and abet criminal activity by their flawed buyer protection program of which I fell victim to. The program allows any buyer to falsely claim, electronically mind you, that they never received their item or that it was not as described. Without hesitation, Paypal refunds them their money and the buyer looses. Paypal is NOT a legal entity and has NO RIGHT to act on the behalf of the buyer or seller. The US Post Office and local criminal courts already have methods in place for this.
To add insult to injury, I proved to paypal over several months that their OWN WEBSITE and INTERNAL SYSTEM was flawed. As a buyer, you can tick a box on ebay at checkout DECLINING TRACKING ON YOUR PACKAGE TO BE SENT. However, the option to tick a box later claiming you never got the item or that it was broken, etc., IS STILL AVAILABLE AS AN OPTION!!!! I’ve explained to them that once they tick that DECLINE TRACKING option, then they should LOOSE THEIR RIGHTS as outlined in PAYPAL’S OWN RULES!
After proving my items were sold on Craigslist months later to my failure of a Paypal last in line contact, he actually said he didn’t care and even with this proof, it all came down to the TRACKING!!! Umm… but I just proved my buyer DECLINED TRACKING AND GAVE UP HIS RIGHTS. Paypal dude didn’t care. THAT IS CRIMINAL ACTIVITY!

I’m a Powerseller, perfect record, 11 year customer of PP, have a merchant terminal with PP,
been on eBay full time for 14 years, and use their debit card daily. I call they can’t tell me
why my funds are pending. Horrible. I always end up in tears and the hours I’ve spent dealing
with them has been in the 20+ hours so far. Amazed that they can’t tell me anything other than this:
“due to other sellers unethical behavior, we have had to implement these guidelines across the board.
it’s the bad sellers that have done this to the selling community, and therefore we have to protect ourselves
against fraud. By placing a percentage held in your account it will protect us from possible future chargebacks
on your account”. CRAP! Never had a chargeback or a problem. We have to jump through bullish*t hoops to
be stay a Powerseller. I’m so far in bed with PP and eBay that I can’t get out. I wish I could.. I wish I could!

I am a small time ebayer with 100% positive feedback, and a friend asked me to help her close out her photo business for her by selling her gear on ebay. As soon as the $18,000 in sales hit my account, they closed it. I only write this because I hear about people being out $900 or $1500….. no, it can be a lot worse. They will give no reason. Just sold everything extra we had in the house so we could have some money to buy Christmas presents. We were able to make 1700.00. My son sold his Pokemon collection and I sold the guest room bedding. Paypal put a limitation on my account that I could not get my money until I proved everything had shipped. I did prove it had been shipped and called back. They had more hoops for me to jump through including sending receipts for all items I listed as new. I did that. After doing all of it, they then told me they would forward it to be approved and it came back as denied and they would be holding my money for 180 days, six months, for no reason. Just to protect them from chargebacks they said. We will have no money for Christmas presents this year.
I recently sold tickets to Game 1 of the 2011 world series to a verified buyer on Paypal and forwarded the tickets via email after I verified the funds were in my account and that the email address was good. Well a few hours later paypal puts a hold on my a ccount. Here I am 4 days later having sold 2 ticket for barely over face value in order to cover ebay and paypal fees and am told unless the guy who went to the game says he did I am SCREWED. SO MUCH FOR VERIFIED BY PAYPAL. WHAT A JOKE.
I contacted the law firm, we are out in one account 15,000+ and 55,000+ we have tried to take credit cards on ebay, they only issue transactions for 1 dollar, thus, cc work but only for a dollar transactions, meaning, only paypal can be used. The contracts paypal changed AFTER they started this scam, 55+ times in a single day. They have told us by phone and email that they have no obligation to give any reason as of why they hold the money, the money they say, is there, right : ) in the webpage. They make billions in interests and they pay no taxes ( that is right ) because they claim they make no money and they don’t own the money, is us, so if it is a refund, they feel they don’t need to pay taxes. Another huge scam, the rolling reserve has no way to export the balance, once they are generous enough to give you your money, the record vanishes, there is not trace of any past days, no way to check if they gave you the money, for the record, they sometimes forget to give you the money for days or perhaps forever, many accounts are closed and totally restricted which means, they keep the money rolling forever, I think there are some groups organizing to Occupy Paypal, this class suit can be the biggest ever, this is a huge scam, paypal is not a secured bank so if they go out of business, the rolling reserve money is gone too, since they don’t claim to be banks, they think nobody notice it. Banks don’t scam so sarcastic, at least they paint it nicer and they do not force their own set of laws on people, there are website terms and conditions and there are laws, paypal clearly breaks the law without caring about consequences because is what the top executives make what counts. Hello everyone I first started using PayPal in March of 1998, one of the very first merchants to sale products on eBay with more than 1.2 million sales on eBay and with a 99.2% feedback rate.
I have really never had any problem with eBay or PayPal until now, they started holding funds from my account to cover chargebacks or reversals after all these years I have not had one chargeback or reversals.
I have really never pulled money out of the account other than when I purchase something myself online, at this point I have over $311,000.00 in my PayPal account. I am not paid interest or dividends on the money therefore I do not have to pay taxes on it “it is not in my possession so it is not income”.
Recently put a hold on 121,000.00 of that for 180 days I contacted them about this and they told me the same thing that the email did, it is being held for chargebacks and reversals. So to make a long story short the bank account that is associated with my PayPal account is now a revolving account when money is deposited into that account it is immediately transferred to another account.
I have since transferred the balance of my PayPal account to the bank account associated with my PayPal account and it was instantly transferred to another account not associated with PayPal, guess I will just start paying taxes on it.
Here is the thing PayPal; how can I put this “Screwed the pooch” when the remainder of the money is available in my account I will transfer that to leaving only a balance of a week sales in there, I will continue to transfer money out of my PayPal account from now on once a week.
Solution: This is so easy pull your money from PayPal only leave enough to cover any charges, then PayPal will get the message when in fact there stock holders and/or bank account start shrinking from the lack of interest from the holds and/or account balances.
I have contacted a lawyer about this and he is checking into it, but as he told me they have a fleet of banking lawyers that know the law inside and out, the best way to get to them were hurts them most so they feel it is in the pocket.
Take away that interest and available assets and they have nothing to run on except there fees and then maybe they will rethink their policies.
Hello, I have been a victim of Paypal in 2005 and 2006 and then somewhat this week.
I spent quite a bit of time trying to get things right then and could not . I know it cost me $661.00 in 2005 alone. I best like to forget about it until I am reninded like this week. If there a way to recover any money through a class action suit?
Not sure if any one knows this, but Pay Pal ARE registered as a BANK in Luxemburg and therefore do need to comply with EC (European) Banking regulation…..

I have figured out a few things that may be helpful. You can get a prepaid visa at any walmart for 3 bucks. You make that your “verified” account

You can change it as often as you want. For example in your case you couldnt remove your backup account. True,
But what you can do is add a different account (walmart 3 bucks) then change your settings to make it the primary account…verify it and delete the account you had initially….a pain…sure but you can work around their software.
I change my account every month and.never.give them any real banking info…just a throw away card from wally world.
